In 2024, the Governor signed transformational NIL legislation that updated the previous NIL law. The legislation, which went into effect July 1, 2024, among other things, allows universities to identify, create, negotiate, facilitate, support, engage with, assist with, or otherwise enable NIL opportunities for student-athletes. What is Name, Image & Likeness ("NIL")?

NIL is a term used to refer to the compensating of student-athletes for the use of their name, image & likeness. Examples include being compensated for social media posts, endorsements or appearances. NIL activity cannot be pay-for-play (that is, in return for athletics participation or achievement), and cannot be an inducement to attend the University of Virginia.

Does the University of Virginia preclude any activity?

The University has discretion to preclude a student-athlete from participating in NIL activities while engaged in academic, department, or official team activities. Academic activities include, but are not limited to, class, tutoring, meeting with an academic coordinator, or academic services.

I am a student-athlete, what should I know about agreeing to an NIL opportunity?

Please note that an NIL agreement cannot be predicated on performance or being on a team, as that would be considered impermissible pay-for-play. Additionally, while you are permitted to obtain representation for NIL purposes, the representation cannot pursue professional athletic opportunities (if they do, your eligibility will be jeopardized).

I am a business or alumni interested in entering into an NIL agreement with a student-athlete, what should I know ahead of time?

In the past, businesses have had student-athletes make appearances for them, engage in social media campaigns, market services and products, and much more. While there is no minimum level of compensation that must be provided, compensation must be in exchange for work performed.

I am a prospective student athlete interested in the NIL opportunities offered at the University of Virginia.
